The corporation is formed and shall be operated exclusively for the charitable purpose of supporting and benefiting Foodlink, inc., which is a New York not-for-profit corporation (Foodlink), such other organizations described in section 501(c)(3) of the internal revenue code of 1986, as amended (the code) and section 509(a)(1) or section 509(a)(2) of the code that solicit, collect, store and distribute food products for the ultimate consumption by the ill, needy, elderly or children, and programs which serve the needs of the undernourished in the greater rochester metropolitan area. It is intended that the corporation will primarily support and benefit Foodlink, which is an organization described in section 170(b)(1)(a) (other than in clauses (vii) and (viii)) of the code. The corporation shall carry out its stated purposes at all times within the meaning and intent of section 509(a)(3) of the code.
